TUNIS – UNIVESRNEWS L’arsenal juridique mis en place par la Tunisie depuis la révolution pour la lutte contre l’évasion fiscale, la fraude fiscale, la corruption et le blanchiment d’argent est colossal.
L’élaboration de ces textes a été un gage de la Tunisie exprimant un engagement vers la transparence de sa gouvernance et la poursuivie des délinquants responsables de la fuite des capitaux.
Des économistes rapportent que les fonds en devises illicitement transférés vers l’étranger auraient été suffisants pour financer le développement. Selon le Tax Justice Network (ou TJN) (groupe de défense composé d’une coalition de chercheurs et d’archivistes partageant une préoccupation commune concernant l’évasion fiscale, la concurrence fiscale et les paradis fiscaux) la Tunisie a un niveau d’évasion fiscale de 413 Millions de dollars en 2021. La perte de revenus des taxes est équivalent à 24% du budget de l’Etat pour la santé.
En dépit de ces textes, les économistes autant que le citoyen lambda ne voient pas encore les bienfaits de ces textes. Est-ce l’absence de textes d’applications, un laxisme au niveau de l’application ou l’absence de structures et de moyens nouveaux.
Résultat des comptes, l’économie tunisienne souffre de ses maux et le tunisien souffre encore des affres de son désespoir.
Il serait cependant insensé de penser que la fuite d’autant de fonds vers l’étranger se fait via des valises à travers les passages frontaliers officiels ou de contrebandes seulement. Les délinquants fiscaux opèrent probablement via des circuits plus discrets qui rivalisent d’ingéniosité en profitant de régimes fiscaux différents de pays dont ils ont les nationalités ou les résidences pour ne s’acquitter de leurs dû ni dans l’un ni dans l’autre des pays. Ils sont nulle part. or la réglementation tunisienne en la matière est claire et précise sur la notion de « résident fiscale, résident-change ». Ces textes précisent en substance le fonctionnement des comptes en dinar convertible et des comptes en devises qui sont des comptes de dépôts lesquels dépôts ne peuvent provenir que d’une Économie étrangère. La communauté des experts se demande, comment expliquer par exemple que des loyers ou de revenus de ventes d’immobiliers tunisiens puissent être déposés dans un compte en dinar convertible et transférés à l’étranger par un tunisien ? Comment expliquer qu’une créance tunisienne puisse être réglée à l’étranger et ne pas être rapatriée en Tunisie. Comment est-ce que le produit de litige avec une entreprise étrangère ne puisse pas être reversé dans la société tunisienne qui a gagné ce procès ?
Pour éviter les accords bilatéraux entre pays, en matière de lutte contre la fraude et l’évasion fiscale, ces délinquants usent probablement de leurs multinationalités ou multi-résidences pour échapper à cette étreinte en transférant leurs flux sur des paradis fiscaux ou pays connus pour leur souplesse et discrétion en matière de transferts de fonds du moment que c’est introduit sous la bannière de l’investissement.
C’est l’une des pistes à explorer qui reste cependant tue ou ignorée par les analystes compétents en la matière.
