TUNIS – UNIVERSNEWS – La Chambre de première instance du Tribunal Administratif de Monastir a décidé le report de l’exécution du permis de construire délivré par la mairie de Monastir, le 13 janvier 2023, au profit d’une société immobilière qui comptait ériger un immeuble sur un lot de terrain situé derrière le Mausolée de la famille Bourguiba.
Une pétition signée par 11 associations régionales à Monastir, a été déposée, en mai dernier, auprès de la Municipalité de Monastir en vue de suspendre les travaux de construction d’un bâtiment de 4 étages sur un lot de terrain situé derrière le Mausolée de Bourguiba.
Le président de l’association de Sauvegarde de la ville de Monastir, Habib Al Ghali, a souligné une décision préliminaire, en attendant le verdict final du tribunal. Pour sa part, l’avocat de l’Association, Anis Besbés, a fait savoir que la municipalité de Monastir et la société immobilière concernée ont été informées de la décision du tribunal par huissier de justice.
L’association a porté plainte d’urgence, le 7 juillet courant, en vue d’annuler la décision du permis de construire. En vue d’anticiper une éventuelle complication de la situation, une plainte pour suspendre et reporter la décision municipale a été également déposée.
La construction d’un bâtiment dans cette zone constitue une violation du Code de protection du patrimoine qui interdit toute construction sans l’accord préalable de la partie en charge du patrimoine.
Toute construction illégale risque de défigurer le site classé patrimoine national depuis le 21 janvier 2021. Ce monument situé dans la zone touristique constitue aujourd’hui une destination privilégiée pour les touristes et les citoyens.
